Mission

This web-site : : Coronado Heights Home Owner Affiliation : :  (CH HOA)  —AN UNOFFICIAL RESOURCE FOR MEMBERS OF CORONADO HEIGHTS ASSOC. INC. (CHA), was created (and is maintained) by MetaMEDIA Communications in January 2017 as a public service. It is an independent,  non-profit entity, separate from the Coronado Heights Association incorporated in Washington state in 1994 (CHA) . CH HOA  is an Affiliation as opposed to an Association as no registration or membership is required to use the web-site. The Board of Directors of the CHA exert no control and are not responsible for any content posted on the web-site.

The primary purpose of the web-site is to promote and provide transparency through an easy-to-use web-based portal to facilitate convenient, secure access to comprehensive information, including archives of financial and CHA actions and resolutions,  along with rich media such as images. Hopefully, for the uninitiated it will also provide a broad historical context/continuity, 24/7 as more info/documents, listed chronologically become available for CHA Members.

In the event of a major emergency, like a catastrophic seismic event resulting in massive local/regional property damage(including roads and infrastructure) and serious injury, this web-site could serve as a valuable communications hub specifically for CHA Members in keeping the Members informed, marshalling emergency response resources including request for aid from its Members. In the event of a major earthquake, with the probability of most landline services severely damaged/interrupted(telephone, internet, and cable tv), this web-site has been created and tested to be viewed/interacted via internet services provided by mobile phone network purveyors on both Apple and Android phones.

While the web-site is viewable by the general public, certain proprietary information including financial, legal and minutes of meetings are protected by password to ensure security and viewing by CHA Members ONLY. CHA Members can request a password by using the form below Go to: Contact US or emailing the Administrator. For security purposes please be sure to include your full name as recorded with Whatcom County (Property Tax Statement) along with your recorded physical street address in your request. Until further notice, the password is the same for all protected content.

 A Brief History

The Coronado Heights Subdivisions  1 and 2 were created in December of 1994. (see PUBLIC OFFERING STATEMENT)

Explicit in the Articles of Incorporation as a non-profit tax-exempt organization is a legally mandated responsibility to form Coronado Heights Association (CHA). The Conditions, Covenants, and Restrictions (CC&Rs) are an encumbrance recorded on each property’s title within the CHA. Coronado Heights Division No. 1 consist of 19 lots, and Coronado Heights Division No. 2 consists of 29 lots for a total of 48 lots. The owners of these lots constitute the total membership of the CHA.

The governing documents provide Classes of Membership and Voting Rights as follows: for only one (1) class of membership with all lot owners having one (1) vote for each lot owned. Each member shall be entitled to vote provided his/her voting privileges have not been suspended by the Association for failure to pay any assessments or special assessments and any charges associated therewith.

Membership and financial participation in the CHA is a legal condition precedent to ownership/title: It is not optional. CHA Members are required to pay an annual assessment to the CHA as provided in the covenants. THE AMOUNT OF ANNUAL ASSESSMENTS MAY BE INCREASED FROM TIME TO TIME AS A RESULT OF INADEQUATE CASH RESERVE CAUSED BY ANY REASON INCLUDING NONPAYMENT OF ASSESSMENTS BY MEMBERS.

CORONADO HEIGHTS ASSOCIATION is a Washington NonProfit Corporation. AS A NON-PROFIT CORPORATION, THE ASSOCIATION CANNOT MAKE A PROFIT FOR DISTRIBUTION TO ITS MEMBERS, OFFICERS OR DIRECTORS. WERE IT TO ATTEMPT TO DO SO IT MIGHT LOSE ITS LEGAL STANDING, BE SUBJECT TO SUIT, OR LOSE CERTAIN MEMBER IMMUNITIES AND TAX BENEFITS. ITS PRIMARY PURPOSE IS TO OWN AND MANAGE THE COMMON PROPERTY FOR THE BENEFIT OF ITS MEMBERS.

Effective collection of assessments is an important and necessary part of Association management and your common ownership. Unpaid assessments may result in financial problems for the Association and a greater financial burden being placed upon other members. Unpaid accounts, including interest thereon and costs, if any, become a lien upon such lot from and after the time the same becomes due and payable until paid in full. THE ASSOCIATION IS AUTHORIZED TO TAKE SUCH ACTION AS PROVIDED BY LAW TO COLLECT UNPAID ACCOUNTS, INCLUDING BUT NOT LIMITED TO LIEN FORECLOSURE ACTION.

In 2015 a majority of owners of the lots within the CHA convened to formally/legally ratify a resolution to take full control and responsibility for the administration of the CHA. This action was primarily prompted by a demand made by Whatcom County to remediate severely deferred maintenance of the Detention Pond, which has gone unmaintained since its creation in about 1994.

We live in a very special place of awesome natural beauty. Along with the right to “quiet use and enjoyment”,  also comes a legally mandated(and moral) responsibility to protect and maintain the pristine beauty of it from environmental harm.

The CHA is responsible for upkeep and maintenance of the Detention Pond, common property, and alleyways. Coronado Lane and Columbus Ave are private non-dedicated roadways not maintained by Whatcom County. It is the sole and exclusive responsibility of CHA Member lot owners using said roads for access to their respective properties, under the purview and administration of the CHA Board, to pay for the ongoing repair and maintenance(including snow removal) of the roads. None of the General funds of the CHA are to be used for such repair and maintenance.

The principal purpose of the Detention Pond is to mitigate flow from watershed of contaminants and toxic substances from polluting Lake Whatcom, which serves as a fresh water reservoir for Greater Bellingham. Pursuant to applicable Whatcom County Ordinance(s) and CHA By-laws etc., the CHA is legally obligated to maintain(at its sole and exclusive expense) the Detention Pond to Whatcom County’s environmental standards. The Detention Pond is situated between Columbus and Lewis Ave on the Eastern side of the subdivision.

The CHA is currently in the process of remediating the Detention Pond to the strict standards of Whatcom County. Much work has already been accomplished at the direction and hard work of President Rick Kiene and some CHA volunteers, but much remains to be done. The Board is working diligently in collaboration with Whatcom County in a multi-phased approach, to ensure timely completion of the project with the ultimate goal of final approval by Whatcom County.

It should not be left unsaid, that the CHA will have an ongoing responsibility for future repair/maintenance of the Detention Pond indefinitely.

IMPORTANT: RESPONSIBILITY OF HOME OWNERS 
From time to time, inevitably properties will be bought and sold within the CHA boundaries causing changes in ownership/title etc. The recent reformation of the CHA(2015) will now mandate heretofore non-existent general and special assessments, including ongoing expenses for the Whatcom County mandated remediation of the Detention Pond.

Under the rules of full disclosure of sale, it is therefore the responsibility of the Seller to inform the Buyer, of the existence of the CHA and the ongoing mandatory financial liability(eg Detention Pond) to the CHA by referring them to the CHA Board Members. And directly notifying the CHA Board of the Sale and the contact information of the new owner(s). It is therefore suggested that the Seller direct the Buyer to this web-site to aid in the disclosure process and orientation of the Buyer’s participation in the CHA.
